I got three "notice of determination" letters from NYS DOL saying that I am not eligible for benefits from 8/30/2020 to 9/16/2020 (three weeks when I was out of country) and my right to further benefits has been reduced by a total of 12 days until 2022.

What confuses me is that they said I circumvented the system - I thought if you did that you lost 80 days(?) of benefits.

Did I just get off easy? I was very responsive and honest for this entire back and forth that has lasted over a month.

I have been claiming and getting money for the last 1-2 weeks from DOL with no issue. I just want to ensure I won't have to pay it back.

Any thoughts?

"Under the law, a claimant who has willfully made a false statement or representation to obtain
benefits shall forfeit benefits for at least the first four but not more than the first eighty effective
days following discovery of such offense for which he or she otherwise would have been entitled
to receive benefits.
Such penalty shall apply only once with respect to each such offense."

Be happy with your end and stop complaining, it could have been worse.

**What confuses me is that they said I circumvented the system - I thought if you did that you lost 80 days(?) of benefits. ** how did you come up with 80 days for 3 weeks? is there a formula for that?
