Hate to break the news to you champ but you are a real criminal. Do a little research to see how much "petty" theft costs both businesses and ultimately us, the consumers, for your little indiscretions. The jails are full of petty thieves. Agree with that or not it's a fact of life. Generally these thieves only see short jail sentences but they DO go to jail on a regular basis. I'm not surprised that your charge is not in NCIC as it is a misdemeanor but that doesn't mean it's not out there in criminal land. You won't be extradited from here for a charge like this and eventually the original charge may go away (I said may, not will) but the bench warrant for failing to appear can stay around much longer.

Okay, people break the law all the time! I got caught, sure, I made a mistake that I do plan on correcting when I go back home to CA. I'm not going to jail, it's not a bookable warrant. Of course I will not be extradited, I didn't kill anyone!!! There is a difference between me and a ****ing terrorist, that is what I consider a "real criminal".

themommy, yes I am a criminal, now you can go back to breastfeeding or whatever you do. Relax. There is a difference between me and a murderer, right? You probably think anyone who breaks any law is a criminal, petty theft and posession of child pronography is NOT the same thing!!!! Calm down.

Settle down Hoss. You're getting a little carried away. You asked a question on here and you are receiving a multitude of responses. Not sure what you expected. You sound young and you can likely survive this without a problem. But don't go and get all upset with those trying to respond to what you've asked.

Why were you desperate for a shirt? Did you not have a shirt on?

I appreciate all the responses from everyone with advice. [....] Like it or not, al crimes are different, some are more serious than other. Petty theft is LESS serious than grand theft, child abuse, murder, felony drug charges, etc. Even if I wanted to go to jail for my outstanding warrant, they won't arrest me. IT'S NOT A BOOKABLE WARRANT!
Yankeesfan- You know I was 21 at the time, I had a shirt on but it ripped on accident so you could see everything, so i though, OMG just one time, I didn't know I had forgot my cc, so... stupid mistake anyway.

FYI, all background checks are not equal. There are powerful databases out there and it really just depends how much the employer wants to spend. It may come up and it may not.

Regardless, if the warrant is really minor, you should just take care of it instead of always worrying about it. Who knows? Maybe the store will drop the charge if you reimburse them and write a sob story letter about how sorry you are and turned your life around. It's not like they want to be dragged in court as witnesses for a 2 bit crime.

Yes, you are correct, all crimes are different and that is why they all have different levels of punishments. But that is the criminal justice system. In the commercial world of recruiting departments, do you want to know what is one of the top "crimes" that will immediately get you thrown into the "NO" pile? That would be "Theft" (whether petty or not). Companies are actually more likely to hire someone who was in possession of kiddie porn (a crime that is likely not to rear it's head in an adult workplace) than someone who was convicted of "theft" (something that could easily bring the company down). I do realize that you have not been convicted, but them finding a warrant that you have ignored makes them think that you are a) irresponsible and b) a thief. I assure you that no one will hire you if they find that.

It is possible (perhaps likely) that they won't find it, but I'd hate to have to deal with that monkey on my back, always wondering if or when they will.
