I moved into a house in Arlington and three months in, decided to transfer my lease to another person because I wasn't comfortable in the house. My reasons for being uncomfortable were many, but mostly centered around my landlord. He smoked pot in the house daily, never fixed anything, and was generally a disgusting human being.

The day the tenant (who was going to take over my lease) was to move in and I was to move out, the landlord said he would meet with us in the afternoon to sign over my contract and do a walk through of my room. He never showed up and I frustratingly had to leave. I texted my landlord, asking when I would get my deposit, and he said he had thirty days to return it.

Fast forward to almost one month later, and I still haven't received my deposit back! I texted the person who was supposed to take over my old room and asked when he signed the lease. He said he never signed one because the landlord keeps putting it off. It's bizarre because I only had a 7 month lease and the new person wants to sign for a year!

I'm not sure what game this landlord is playing. I know he has financial problems. I feel stupid for getting myself into this situation and I'm stressed because technically, I'm on two leases. If anyone could offer advice on what to do so that the lease is officially signed over and I have my deposit back, I would really appreciate it.

Also, if the landlord does try and deduct anything from my deposit (assuming I ever get it back), what kind of things can he deduct for? My only worry is that while renting, a cabinet door fell off. I was in the house but not in the same room. I think it was a really poorly constructed cabinet, but I bet he will try and blame it on me.

Years ago I had a similar problem, my landlord contrived a bunch of phony reasons to withhold my security deposit. I filed a complaint with Fairfax County's Landlord-Tenant Commission and they sent a notice to the landlord and within a week it was returned. I suggest going that route first before resorting to small claims court. Here is the site with the complaint form to download. Tenant-Landlord*- Fairfax County, Virginia. Good luck.

Out of curiosity -

Did you terminate your lease with the LL?

Also, since the new tenant hasn't signed a lease yet, have they even been paying the rent?

I kept trying to meet with my old landlord but he would avoid me and said my lease would transfer to the new person. I know the new tenant has been paying rent (at least thats what the tenant said).

You may want to ask the mods to move this to the Real Estate - Renting forum on CD. The questions have been asked and answered on that board many times. There is a link on that broad to most state landlord tenant laws (first sticky) and thats a great place to start as it tells you exactly what your state says about Security Deposits.
