I wanted to make sure military families, or anyone renting from a military member, know about the double sided military clause. If a military person owns a house and rents it out, then gets sent back to the DC area, they can make the renter move out before the lease is up. This has happened to so many of the people we have talked to that it must be fairly prevalent. Just a cautionary note.

Thanks for posting this. Military clauses are something most of us know about already but this adds a twist that many may not.

These clauses also apply in the case of diplomats overseas who are recalled to the State Department.

Miltary Clause: I move Dec 16th on orders. I was told that all I needed was a 30-day notice and they would be able to pro-rate my rent for Dec. I gave them my 30-day notice on Nov. 12th and now they are saying that I needed to have it in before Nov. 1st to get the pro-rate. I spoke with them well before that and could have had it in if they would have told me this rule. Is there anything I can do?

If the military clause in your lease says 30 day notice (it should), then you did your part. Go to your legal services office. Or maybe just threaten your landlord with doing that, and give them the opportunity to make it right without getting the lawyers involved.
