My husband is in the Air Force and will be stationed in Virginia for the next 4 years in a couple of months. We are currently residents of California and have no plans of changing our residency. We were intending to buy a new car in Virginia especially since the sales tax in Virginia is a lot lower than Los Angeles. Since we would need to register the car in Virginia, would we subjected to the annual property tax on the car?

Any help would be greatly appreciated!!!

As long as the car is only titled in his name and not both of your names, you will be exempt from the property tax. When you receive the property tax bill, you will just have to send in a copy of his latest LES to show his active-duty status.

Yes, this is VERY important! DO NOT register the vehicle jointly with ANY civilian, even spouses or other dependents....if you want to avoid the personal property tax.

Tell the dealer this up-front and repetitively...they will often assume that a married couple wants the vehicle registered jointly. It's a PITA to change it later if they put it in both names.

I was under the impression that if a vehichle is garaged in Virginia personal property tax has to be paid. No exceptions. Doesn't matter if the person is living in Caliornia, Alaska, or overseas. This changes if one is acitive duty military?

EDIT: just saw the Fairfax website and saw the military exemption...forget i asked

They are working to change the joint status so that a car registered in a military members name and a spouse would be eligible, however that has not taken effect yet. Take the previous poster's advice and have him only buy the car in his name.

I know this isn't a legal forum, but I was just curious if anyone knows...

Could this come back to "bite the spouse in the butt" if the couple was to divorce--would that give the military member more of a legal claim to that vehicle?

I think that depends on a number of things. Joint property state, how amicable to divorce is, etc. I am sure that would be something that would have to be worked out in the courts should the need arise.

The only way I see this as being a problem is if our hypothetical couple were a one car family. If the significant other took the car, but it wasn't in their name, it could be considered grand theft auto, should someone decide to pursue that.....

Just my thoughts on it

You can finance the car in both names, and only register in one. That is what we did.

I live in Tennessee and work as an Active Duty Soldier just over the line in Virginia. I tried to buy a New Car in Tennessee and they would exempt my sales tax if I was stationed in Tennessee. Since I work just across the the line in VA that exempts me from sales tax relief. Does VA have a similar sales tax exempt for Military Stationed there who will register their auto in Tennessee?
