I'm getting a bit of a laugh out of this.

I'll help you out here, make an all day recording of the dog barking, go to the courthouse and file the frivolous lawsuit.
Show up in court and get laughed at by the judge as well as the gallery.
Perhaps the case is viable and you win the suit. You will then have neighbors who may hate you.
Being a lawyer you must realize that you don't have a case unless you can not only prove that the barking happens (hence the recording or witnesses) then you have to prove that the barking has harmed you in some way or has cost you money.

Better yet move again, this time to a dog free neighborhood ~♥~
Judging from the username and single post, the OP's probably a troll. If not, the way that some folks in Hawaiʻi solve a "barking dog" problem is illustrated in the clip below starting around the "3 minute" mark (i.e. "Adora, the black lab")...

Honestly, I don't really think the "psyche of the dog owners" is really relevant to any lawsuit associated with barking dogs. It's going to be mostly about the extent to which the barking interferes with your right to enjoy your property, regardless of the dog owners' intentions.

At any rate... I agree with the other posters who suggested alternative ways to resolve your issues. Have you even made your neighbors aware of your grievances? Lawsuits really should be a last resort in situations like this, and serving someone with a summons and a complaint when they may have no idea that there is even an issue is not what I would consider the most neighborly thing to do.

Sounds like the OP might be dealing with a schnauzer. The ones I've seen/heard bark a lot. I had one living next door to me. As long as she was inside, I couldn't hear her bark.

Maybe the OP should make friends with the neighbors and the dog. Find out why the dog barks so much. Maybe the dog is lonely. Maybe the dog is hungry. Maybe the dog is bored. While you do have a point, I've met lots of attorneys who weren't real bright. They could pass the bar exam but they couldn't handle life.

If there's a noise ordinance where you live, you shouldn't have to file a lawsuit, simply call the cops. And if there isn't such an ordinance, maybe there should be. I'm sure you know how to go about that.

Either way, calling the police or filing suit would be the last steps I'd take. Talk to an animal trainer to get ideas. Then talk to the neighbor, nicely. Offer to help, either by paying for training or a bark (shock) collar.

My son used to live on a busy street and had two dogs. They weren't bad barkers, but now and then one would bark, either when someone walked by or when another dog in the neighborhood started barking. If someone called the police to complain the cops showed up, and if the dog barked when the cop showed up, son got a ticket for $50. I think the fine escalated after so many, but he didn't get to that point. Instead he got a shock collar for the offending dog, and that stopped it immediately. The dog only had to wear the shock collar for a short time before it learned not to bark.

And this has nothing to do with your problem or how to solve it, but since you brought it up... hang your Harvard Law degree on your office wall and never again bring up the fact that you went to Harvard unless asked. That's not a smart way to make friends and influence people.

I agree with you 110% The owners of the dog are completely at fault. The dog is not. It is completely irresponsible for someone to own and care for a dog and be completely inconsiderate to their neighbors and not take the time to train the dog to be obedient. The owner's are lazy. That's all there is to it. It took my wife and I a long time and money to train our dogs to be quiet and not bark at strangers, other dogs, or bark incessantly when we left them alone. It was a very long and arduous process that eventually resulted in them being quite obedient and quiet. The owners are either lazy, inconsiderate, or more than likely BOTH.

I do agree with trying to work it out in person first before doing filing a formal complaint against them. I think that is a bit much IMHO.

+1 I have a hard time believing a Harvard educated Attorney would have the free time to be on this forum making a non-moving related post.

My thoughts as well. On the chance that the op is for real though, have you ever thought about going to the neighbor's place and politely asking them if they could do something to quiet their dogs first?
