Has anybody else noticed restaurants that don't calculate this correctly? I got a carry-out from the WingStop at 120th and Blondo last week and later noticed that the sales tax seemed off. It was a $5.99 order and they charged me $0.42 sales tax and $0.18 for the rest/bev tax for a total of $6.59. A 60-cent tax on a $5.99 order is 10%, and I knew that it shouldn't be quite that much.

By my math, it should be:

5.99 (subtotal)
+ .42 (7% sales tax)
= 6.41 (total with sales tax)
+ .16 (2.5% of 6.41, Omaha City Rest/Bev Tax)
= $6.57 (grand total)


I really don't care about getting 2 cents back, but I assume their POS system is not set up correctly and all their customers are getting overcharged. Depending on how long that's been going on, it could add up.

I sent an e-mail through their corporate website...it will be interesting to see if they respond. Can a business get in a lot of trouble for this?

Unless you can prove ALL their customers are getting overcharged, they will likely claim it was a one-time accidental error and refund you 2 cents. And in Nebraska, unless someone files a class action lawsuit, proving gross negligence with claims from hundreds or thousands of customers, they won't get in ANY trouble. Way to be heads up, though.

If you order through their website, it will charge you a 10% sales tax. As a test, I added a $72.99 order to my cart and it lists the tax as $7.30 (it should be $7.06). So, they probably are overcharging everyone.

I will give them a chance to correct it. I'm not really interested in getting them in trouble or trying to sue them...I like their wings and they have pretty good service. I've spent too much time over this...just makes me wonder how many restaurants are overcharging and nobody notices because the calculation is confusing and because usually nobody is gonna notice or care about a few cents.

The restaurant tax is supposed to be applied before sales tax.
5.99
.15 2.5 % Restaurant Tax
6.14
.43 7.0 % Sales Tax
6.57 Total


In your example it looks like the total is the same.

If the total was $15, the restaurant tax first only brings in an extra cent.

The restaurant still charged the wrong price though.

This tax in particular is very confusing.
