Agreed. You can't deduct those if a W-2.

Hold it.....if you have a business (and I think you might)....you can deduct lots of things.....all medical + insurances.

Just cerate some income out side of you W2 work....claim the money.....then write off all of your expenses.

Use a schedule "C".

If you play this right.......you will get back all state and federal taxes they take out of your check.

Not the FICA though.

I don't think you can be an employee AND an independent contractor for the same work.

An employee can deduct unreimbursed employment expenses (form 2106) which would then transfer to a Schedule A...not a Schedule C.

But.....it does not have to be the same work.

A friend of mine worked in a group home.

She also had private clients she would sit with as a respite for their families.

I filed her forms as a working AND having a business.

She used a schedule "C".......with a 1040.

that's your friend...and the op has not provided enough information to jump to that conclusion that they are both an employee and an IC. Most employers would frown upon an employee moonlighting as an IC...mainly because it could be in direct competition AND there are legal and ethical hurdles to navigate if they did.

How would the employer know????

They do not see the tax forms of their staff.

I agree we have very little information.

BTW......I am SURE the guys in my crews put pumps on for their friends......on their time......and it is their business.

I just make sure they know it they get caught doing this without a license....do not say they are working under my license.

Here is the info from the IRS website:

Employee Business Expenses

Going out on a limb and assuming that if you are W2 and commission that means you are sales? Which means I doubt there is anything you can "do on the side" to make certain expenses deductible.

Why not???

A sales person could still have any kind of business......You just have to be creative.
