In addition, on three occasions she verbally threatened me by saying, "Be careful, be very careful". This was in passing in the hall and exiting the elevator. Of course, there were no witnesses. The first couple of times I really didn't get it, but when exiting the elevator and before the door closed she said it again, that's when I realized I was being threatened. Following other problems with her I finally decided to report her. On Jan 21st I requested permission from my supervisor to meet with H/R. He called me in and ask what the problem was, and I told him everything. In turn, without my knowing, he contacted the manager, the director, and then H/R. Then called her in to meet with him and H/R. Afterwards I was called in. It was a horrible meeting that went no where. On Jan 24th I was terminated. They scrapped the bottom of the barrel for any reason. I want to sue her in small claims for Defamation of Character leading to my termination. I never knew what she told H/R. All the supervisors adored this girl. She was funny and had a velvet-like-voice that sucked you right in. It's been 3 months and I'm unable to find work. Do I have a case?
This is not a good place for legal advice. Find an attorney that will give you a free or low cost 30 minute consultation, so that you will have real info about your options.

Does a small claim need to be done? If yes, any advice on what to expect with the process?

First, see the post just above yours. Thi is not the best place for legal advice. That said, getting a judgment in small claims court gives you options to collect your money that you don't have without a judgment. Bankruptcy significantly complicates the process. Good luck.
