There is a "group" here, reread my post. And since the home owners have agreed to the covenants when they buy into the neighborhood, the committee here can exert just as much force as an HOA. You sound like you're trying to extrapolate a trend from a single data point.

I live in a neighborhood where the proles (like me) live in plain stucco houses. Up on the hill, our betters live behind a gate and their houses are stucco with stone veneer trim. Other than a slightly larger size, the gate, some interior upgrades, and a sign that announces "The Upper Bluffs," their houses are Pulte junk just like mine.

They don't want you to add stone veneer because you would be stealing thunder from those who bought more expensive houses than yours. You're not going to win this one. Fitzgerald's observation that "the rich are different" didn't come from nowhere -- and they like it that way, even if they're only richer than you by a few bucks.

You won't be able to get control. When it gets to a point to where he can, he will fund the reserves as called for in the agreement and then turn control over to the community HOA and a board of directors will be elected.

You probably don't want control until there is sufficient homeowners and funds to maintain the common grounds.

As far as compliance enforcement, it's up to the developer who is still in control of the HOA.

You may want to talk to some neighbors about having a group discussion with the developer to see what the plans are and how the funding of the reserves will play out.

The subdivision I lived in in Ahwatukee had CC&Rs, but no authority to levy assessments and no HOA. Everyone pretty much followed the rules, but some did not and there was no way to enforce the rules without money. Initially everything was cool, but as time went on and owners changed/renters came we had a couple of homes that were poorly maintained, left the trash cans out permanently, had cars on blocks in the driveway etc.
