I'm just curious... Did the county explicitly say you have to do both?

Kind of related to this, I have a question. Is off-road riding (ATVs and dirt bikes) allowed on private property or do you have to go to a place approved for off-roading?

For example, I'm looking at a place around Eloy that sits on about an acre. It's a subdivision but there's no HOA. Looks like all the neighbors have at least an acre, some more, also some empty lots around it. Are these neighbors allowed to run off-road vehicles on their own property or on the empty lots? Most of the area is just dirt, very little landscaping.

Where I live now they're allowed to race these noisy things wherever they want, as close to other people's homes as they want, even on lots as small as a quarter of an acre. My neighbor even made a dirt racing track catty-corner from my house. I'm looking for peace and quiet away from the roar of off-road engines, and hoped that getting some acreage would provide some insulation from the noise, but now I'm starting to wonder if having acreage would just attract more of it.

At least in Maricopa County I don't believe it is - but I'm not sure of that. You need to check with law enforcement in the immediate area. Check out the Arizona State Parks OHV Program Page. It has a lot of useful info about off highway rules and dust enforcement laws.

We are on over an acre lot in Casa Grande, we are fenced...no one does ATV in our yard but us...Maybe get to know your neighbors, fence along the easiest access at least and post...there needs to be a block so they can't get in easily...I would say one strategic placed wire would do....as far as dust....I would plant something, way cheaper than water, good luck!

Thanks for the link. On that page was a link to the rules for Maricopa, and it says "The property owner, person entitled to immediate possession of the property, or invitee who has lawful authority may operate such vehicles on the property if such use does not violate any other applicable laws." It doesn't say there has to be a minimum number of acres, so I take it that they're allowed to do it no matter how small the lot is, unless the city itself has a law against it.
