Recently I was working and my 15 year old daughter opened the door at our Mesa home and received a package for me from a server. I am not home much of the time. She for some reason thought it was no big deal. I didn't find the package until hours later. It was a photo radar ticket for me from months before. I didn't even know I had a ticket. I never saw a flash, I never received anything by mail. And my underage daughter took this. I put it on the desk in a pile I needed to get to around bill paying time. A week later I have a house fire at my Mesa home and the firemen come and police. During this, the police told me I have a suspended license?!!! WTH!? I never knew anything about any of this. Then I looked it up on Mesa courts and it shows I have to pay 409! WTH is that?! Do I have to p ay this and what do I do? It is possible the information was mailed to my other residence in another town. What are my r ights? Do I have any?!

It sounds like you "did" receive notification, but you chose not to deal with it.

Yes it sucks and yes you do have rights... you have the right to legal advice / representation at your cost.

Your license should not have been suspended so quickly. When I was served there was a due date on the document to either pay the ticket, attend traffic school, or contest the ticket, and if I remember correctly it gave me a month or two to do so. It doesn't matter if they mailed the ticket to another address previously because that method of delivery is not legally enforceable unless you voluntarily respond to it, which you did not. To give you less than a week after legal delivery to take care of the issue is unreasonable. I would call the court and see what they suggest. You may be able to go before the judge and have them reinstate your license and drop any late fees if you agree to pay the ticket or do traffic school.

why am I betting the suspended license was from a totally different infraction that the OP also managed to never receive or put in the pile on her desk.

Please excuse the "suspicious" approach to your problems, Krissyleel . . .

However, it sure sounds like you need to "stay on top" of things a little better. We are all busy nowadays but you need to address everything in the "pile on your desk" at least on a weekly basis, possibly even more often, to avoid this type of fiasco.

As already implied, I have a feeling there's more to this than one "ignored" citation.
