I think you'll find that even their $40/year level service has the same rights.
we sell ours through smug mug so we need the pro account. but if their lower level account has the same terms of service than its worth it to pay a little.
once again free may not always be the best way to go.
im still trying to figure out the smugmug terms and ill be honest i cant. im still not sure if i can sell a link to another site to my photo on smugmug.

You want to sell a link to a photo? That strikes me as a very strange thing to do. So you're not selling your photo, but instead are reselling Smugmug's hosting of the photo. I have no idea. But if you post the question on the Smugmug Pro Support forum on Dgrin and you will get your answer. That's one of the best parts of Smugmug, their excellent support.
Our Terms of Service clearly spell out that Flickr/Yahoo! doesn’t own the photos that you upload. You, as a member, maintain all ownership rights to the photos that you upload to Flickr. Our Terms of Service allow us to,
“use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Yahoo! Services solely for the purpose for which such Content was submitted or made available.” (Please see Section 9b of the Terms of Service for the full text.)
This grants Flickr the right to provide the Flickr service, i.e. create the small, medium, and large sizes, display your photos on the site, etc. It doesn’t mean that we own them. When you upload your photos to Flickr, you retain the rights to your images.
so far we know about photobucket and twitpix. im wondering how many others there are. heres a good one for you...what about right here in city data?? does this in the terms of service apply to our photos too ?

does the above apply to photos or just written content or both?
So if I had an ounce of brain and know how I would build a photo-hosting site that would allow users to display/sell their photos with me taking a 3-5% commission on sales. Sellers would retain all rights execpt for advertising purposes.
I use webshots because it free I'm not a pro so if anyone used my photos I guess I'd be flattered....LOL Now if I was a pro I'd be royally pizzed if I wasn't getting paid.
