No, it's on the kid or anyone that crosses into the street in front of a vehicle...unless it's at a crosswalk where the driver doesn't stop.

Interesting enough, I recall a thread a short while back where a driver was ticketed for 5 mph over the speed limit and many thought the driver shouldn't have been ticketed at all.

Either way, drivers need to drive at or below the speed limit and pay attention, and pedestrians need to stay out of the streets and on the sidewalk.

I just wanted to add that you'd be surprised how quick another object traveling at 25 miles per hour can seem when you're standing still. I've been yelled at to "slow down" on East End Avenue in Regent Square and Melwood Avenue here in Polish Hill before when, to my knowledge, I was driving the speed limit AT 25 miles per hour on both streets. I'm not driving 10 miles per hour everywhere just because some people want to be free-range parents and let their kids roam unattended at premature ages.

I don't blame you. I played in the street when I was a kid, and people sped on our street. I survived, and no one in the neighborhood was ever hit by a car, at least not while I was growing up. Typically, parents won't let their kids play in the street until they're at an age or maturity level where they've proven they're not competing for a Darwin Award.

I'm not going to feel guilty if little Jeffy runs out in front of my car and gets hit even though I was doing the speed limit. I'm still going to drive defensively, and if I see little Jeffy playing near the edge of the street while I'm driving up I'm obviously going to be more cautious. If 25 MPH is too fast for a street - the expectation would be on the property owners to petition for a lower speed limit and/or installation of speed bumps. The onus isn't on drivers at that point.

If you expect people to follow an undefined rule, then you're probably going to be up for a Darwin Award one day yourself.

Not for nothin, but for what it's worth if you do everything right and you mistakenly literally hit a child and kill them with your car, you'll feel guilty. If you don't, then I'd think your a sociopath.

A friend of the family hit a 9 year old girl. She took a month or more to die after never coming out of the coma. In that time she got to know the family from visiting the girl in the hospital. She was cleared of any liability because the girl ran out between two parked cars and there were witnesses to support this. She was and is still devastated and it's been 10 years or more now. The comments people are leaving here show some serious character flaws.

Nobody said they wouldn't feel terrible if they killed a child that ran out in front of them. Obviously, most everyone would.

Do your job as a parent and keep your children out of the street and lessen the chance of children being hit.

To think its the drivers fault if they're obeying the law is ridiculous.

Surely I would feel bad and it would be a terrible situation, but I wouldn't feel guilty. If I did everything correctly, why should I burden myself with guilt?

Gosh, I feel guilty and responsible for this thread taking the strange and horrible turn, that it has, by posting to the OP that he might be able to find a different route through the city to the Vet Bridge as opposed to 376. I had no intent to turn it into a hypothetical nightmare regarding dead children. Someone please help.......

Perhaps I misread or mistook your post. I read it as being flippant and cold about hitting a child. My bad.
