Adultery is defined as "voluntary sexual intercourse between a married person and someone other than his or her lawful spouse."

Should it be illegal? If you think it should be illegal, what should the punishment be?

There should be no legislation dictating the sexual conduct between consenting adults. The status of their relationships with other people, i.e. marriage, boyfriend/girlfriend, etc., is none of my business.

adultery is already illegal, and in fact is grounds for divorce, and the spouse who commits adultery can be sued along with their lover in civil court. at one point in time they could be jailed, and in the olden days they were stoned to death.

So? Are you advocating that adulterers be stoned to death nowadays? I mean, I see you voted yes in the poll....just what kind of punishment for adultery do you have in mind?

The laws vary from state to state. I'm very sure that adultery is not illegal in all states.

grounds for divorce and in some states where it can be sued, doesnt make it illegal, it makes it a civil and domestic dispute.

No, not a crime, but there should always be civil liability for adultery in marriage. That way, either the cheating husband has to pay out the wazoo in child support and in some cases alimony, and the cheating wife, if she is an equal earner, can also pay child support out the ying yang, and in rare cases alimony as well - there needs to be a price tag to cheating.
