They are going to have a tough time with this. Shirley was never the subject of the video. She just happened to be the one speaking that got the reaction from the audience which was the point of the whole video. If this suit happens to work in her favor, then the Tea Party can sue the media for their edited videos and blatant lies and smears. The judge will take precedence into consideration, this will open a huge can of worms which I bet they are not willing to do. Now, if Breitbart's point was to attack Shirley, then she would have a case, but it was not the point of the video.
Breitbart deserves to be taken to the cleaners regardless.

No. What got her in this mess was a libelous post by a right wing blogger.
And now that blogger will likely (finally) be held accountable for his cavalier treatment of truth.
The preface that Breitbart added to the video alone is nearly a slam dunk for libel. He didn't even need to show the video.
What was the preface? Anyway here's some more legal analysis:

There must clear evidence that Breitbart knew that he was promoting false and malicious information about Sherrod."

Excuse me..he did not say those things..she did...he did not edit the tape, he did not cut and paste...what case..just becuase some slimeball lawyer wants to make some money..doesn't mean there is a case here...that will be for a Court to decide...
