The court shows apathy to Prop 8. The matter is being taken to the supreme court which is a more conservative and homogeneous group of individuals.

Court won't force Calif officials to defend Prop 8 - Yahoo! News (http://news.yahoo.com/s/ap/20100902/ap_on_re_us/us_gay_marriage_trial#mwpphu-container - broken link)

How did it get on the ballot to begin with if the vote happened months AFTER the Supreme Court ruled ? I would think it wouldn't have been allowed to be voted on once the Supreme Court made their ruling. My what a sticky mess they got themselves into.

The supreme court was the one who allowed it to be on the ballot in the first place this will most likely rule for the people who voted for prop 8.

I am apathetic but I'd rather allow gay marriage than have it be illegal.

I learned about the initiative process in California and it states that whenever there's a proposition being put up for a vote, it first has to be cleared by the California Courts that it is a constitutional proposition. If they rule yes the proposition is constitutional, then it is put up for a vote. The California Courts have ruled it CONSTITUTIONAL BEFORE it was put up for a vote!

At least it'll show us how corrupt the 9th Circuit is, full of liberal activist judges. Where were those scumbag activists at when the Patriot Act was being voted on?? And then we see the same thing by...what a shocker....the 9th Circuit battling against Arizona's SB1070

Did people bring forth a case with appropriate standing against the Patriot Act?

I guess you missed it last week when the Ninth Circuit ruled that law enforcement can come onto your property and secretly affix a GPS tracking device to your vehicle. It wasn't en banc, so a three-judge panel heard the case and issued the unanimous verdict. The judges? Two of them appointed by President Ronald Reagan, the other appointed by President George W. Bush. Yeah, real liberals...

Now, please tell us what part of Judge Walker's use of precedents in the Supreme Court's Romer v. Evans (1996) and Lawrence v. Texas (2003) decisions you disagreed with.

Well?

Because anyone can get anything on the ballot, all you need is enough signature. You can get something on the ballot that says all blue eyed, blond hair, individuals should be forced to lay in a park once a day naked, and they are only allowed to get up after they get raped. All it takes is enough signatures...

I think the Supreme Court might rule that gays should be allowed to get married. I've changed my opinion on this after further analizing the argument that a limiting of gay marriage violates the Constitution. While I disagree with the argument, they do make a very compelling case for legalizing it..
