it seems to me that open carry should be viewed as a law abiding citizen exercising their second amendment rights, rather than someone looking to commit a crime. criminals tend to carry their weapons concealed so that they can surprise their victims to gain the upper hand.

in my opinion these cops, and ones like them, need to be eliminated from the police force, or reeducated on the law. the police in the OP are going to lose their lawsuit and have to pay up.

This kind of thread makes me wish we were actually a police state for a year or two just so people like the OP could understand what a police state actually is, stop throwing around terms they don't understand, and learn to actually respect what we have in this country.

Hey, I am the first one to come down on the police when they behave badly, but I think that is not the case here.

He will not win the civil case, and this is why. Most sane people get a little concerned when they see a person walking around with a gun strapped to their hip, that is not a police officer. They guy was just looking to make a statement. He did. He said that he was an idiot.

Seems like he knew the potential consequences of his actions. Walking around with a gun on your hip, legal or not is going to prompt irrational people to dial 911. Any person with some shred of common sense would know or think this. Looks like he was seeking a payday and found it.

Common sense has nothing to do with it. It was within his right to do what he did. Others should just mind their own business. Add in the cops presuming he was doing something wrong and tossing him around for no other reason and yes you have your lawsuit. All they had to do was say hey we go a call what the hell are you doing. He says I'm walking my dog. End of story. They show up guns blazing looking for "action". Good thing it wasn't concealed and somebody saw it jutting out from his hip. They probably woulda shot his ass and asked questions later.

He's going to win. It's a civil rights violation, regardless of what you or other statists think of it. He isn't going to be the first to win such a lawsuit either.

Common sense have everything to do with it. I know that it is perfectly within his rights to open carry but c'mon. This isn't the wild west. It IS NOT commonplace to see someone walking down the street with a gun on their hip. He had to assume that someone was going to call 911 and he was going to have some type of interaction with the police.

I'll say it again, he was looking for a payday and found it.
