The Arizona Senate on Tuesday approved a bill that would allow doctors withhold information about prenatal problems if it could make the decision to have an abortion more likely.
Barto claimed that a doctor could still be sued if there was evidence of wrongdoing.
“If a doctor intentionally or knowlingly withholds information then a lawsuit could be appropriate,” she said. Opponents of the bill insist that it’s a solution in search of a problem.
Then I have to agree with the last sentence. Who is being protected from what? I haven't read the bill but unless it say's it's OK to withhold info I don't get the fuss.

That seems to be exactly what it says. It's making it ok to withhold the information so that there will be no grounds to sue.
Well, I'm no lawyer. I had to read it a few times before making any sense out of it.
It seems that (D) is a problem...how can one prove INTENT on the part of the doctor? From what I can understand, proving intent is the only way to file a suit for damages.
Isn't that more along the lines of protecting the doctor should the birth be anything but healthy ?
No doctor can guarantee 100% that either the baby is healthy or there is something wrong.

I suppose some doctors who are opposed to abortion would intentionally not tell the woman (a lie of omission) that her baby has a defect, because, if she knew she may elect to have an abortion.
So...they think a doctor should be able to lie to a woman because they don't think she's intelligent or emotionally mature enough to make decisions for her own family? This is about a doctor not wanting to be sued when the woman finds out that the doctor lied to her?
