This is a good ruling - I have often wanted to work through my lunch break - and became irritated when my supervisors would be demanding that I leave my workstation: and that is really all that the break amounts to for many people - moving from one place to another for a duration of time. How I use that time should be my business - and if I choose to be productive with the lunch period - and my employer is happy - they should not have to be monitoring what I do during that period simply so they don't run the risk of being sued.
The OP mistitled the thread. Employers are still required to provide a lunch break period. The difference is that employees are now allowed to use those periods in whichever manner they wish. This is a victory for people who understand that the workforce is comprised of adults and that we don't need to be babysat - we are capable of making decisions on our own!
Why anyone would be critical of this outcome is beyond me.
Those employees that you think are insane for working through lunch will be the ones that succeed and will one day be your boss...!
You are correct though. Employees still get lunch break, but the way it is now, if some work through lunch, the government can fine the company. If you work for a large nation wide company, they can fine you, not for the one dude who worked through lunch, but by the total number of employees the company has nation wide. So if you company has thousands of employees and one of them works through lunch, your fine amount is based on the fact you have thousands of employees. Large companies are nailed to the wall for one guy who is trying to catch up on his work. The new law was necessary.
Funny, I've been able to complete my work AND take a break AND extra projects all at the same time. Guess they won't be my boss one day.
