If a doctor performs an abortion on a 33 week gestation baby, it is murder. Many premature babies at 31 to 33 week have a high survival rate. They are fully formed and viable outside the mother.
Um, I saw a pretty old Law and Order:SVU episode where an alcoholic was arrested for drinking heavily through her pregnancy so I'm thinking this is nothing new, at least in NY. She got a warning and did it again so she was arrested again. I know it's TV but L&O doesn't make up the crimes.
According to the pro-choice Guttmacher Institute ---
"even after fetal viability, states may not prohibit abortions "necessary to preserve the life or health" of the woman; "health" includes physical and mental health."
If the woman found a doc who'd do it, I think she could have legally aborted.

It goes to the same law, of jailing pregnant drug addicts, and also charging women with child abuse, if the baby is born addicted to drugs. So, where do you draw the line?
The line should be drawn between not being pregnant and being pregnant. Once a woman is pregnant, both the woman AND MAN are now responcible for another life. Everything should start with that premise.
