Not too surprisingly, the now dead CRIMINAL'S family showed up and was not too pleased. One of them said the home owner shouldve announced he had a gun and was willing to use it. One also said the dead CRIMINAL deserved a second chance.

First, no home owner has to say or warn the criminal of anything. Once you went through with breaking in, its over for you.

Second chance??? The criminal had a long rap sheet already. Still on the streets. He has had not just a second chance, but many more.

There are always "reasons" and "excuses" for the perp.
He was a "good boy".
He was abused and misunderstood.
He would never hurt anybody.
etc. etc.

The bottom line is, he was in a house uninvited. The home-owner took him down. End of story!

I'm a firearms instructor and obviously pro 2-A. I hate criminal scumbags with every fiber of my being. That said, if I see someone attempting to climb through my window as the article states I would issue a verbal warning before opening fire. The sound of a racking forend also helps in many encounters. The risk of liability is too great to open fire unless they are actually a direct threat. Take note of my location though. Things wouldn't go so well for me here in this scenario.

In Texas you would not be required to warn them or to attempt to retreat.

He should not have announced anything. If the burglar had been armed and the home owner made any sound whatsoever, he would be giving away his position to the burglar. He did the right thing by shooting the burglar without a warning.
