Am I understanding this right?...It's late and I'm a little tired.
Senators Toomey and Mancini worked out an agreement to let federal gun law (that trumps the states laws) allow licensed concealed weapon carriers to carry in all states. This would include New York and Illinois.
This would be a kick in the butt to Gov. Cuomo and Mayor Bloomberg of New York City. (The man that put up so much money for a new law).
The good ole pistol packing boys from the rural areas would be walking through New York City with a little more swagger!
These sound like reasonable compromises. If the federal government is going to force their regulations concerning the purchase and ownership on all of the states, they should be equal. Every state allows and respects driver's licenses from other states, why not firearms licenses? This is a proper implementation of the commerce clause.
That is even more true with regard to firearms dealers and the lawful sale of firearms. According to current federal law, you can not purchase a handgun out of state. This is an obvious restraint of free trade and something that should have been found unconstitutional under both the commerce clause and the 2nd. What other legal product can not be purchased out of state? Automobiles, no problem. Baseball bats? Sure. Knives? No restrictions. Gas? Cigarettes? Why do something as silly as restricting the rights of someone to purchase a handgun out of state? Many of us live in states near borders, where the largest and most convenient city is across state lines.
Since the bill includes universal background checks, and since these checks are supposed to address gun crimes, a simple change of purchase laws and recognition of carry laws across state lines shouldn't be a problem.
Alaska already recognizes all concealed carry and other firearm permits issued by other States. You can open or concealed carry in Alaska without a license or permit.
While Congress can determine how State issued firearm licenses and permits may effect each State, they cannot impose a unfunded mandatory background check. Only the States have that authority. So sayeth the Supreme Court in Mack and Printz v. United States, 521 U.S. 898 (1997).

It's not mandatory -- only prospective gun owners have to undergo it.
The Feds set certain standards for driver licensing too, which ensure that driver's licenses issued in one state are valid nationwide. Is that an "unfunded mandate" too?

It is my understanding that it already has. CO passed "new gun laws", and Magpul announced they will be leaving CO to set up in a more friendly state. About 200 jobs, GONE at the stroke of the Governor's pen!

Texas is telling manufacturers or firearms from all over the country that they will be welcomed in Texas..... To my understanding, so far, 30 manufacturers and accessory companies have recieved a personal letter from the governors office..... Send em all, we'll take em....
Oh, and the Texas Senate just passed legislation to allow the governor to make certain inducements to these companies for relocating here... The House will be a mere rubber stamp and I guarantee you the governor is gonna sign it.... Texas is serious about wanting to be the gun production and support capital of the country...
I'd love to hear the arguments on this. Suddenly it'll be about localized control and states' rights.
