Anyone who is smart enough knows that McDonald's has it's own brand. In knowing this, why wouldn't he look for a restaurant that may provide this option? If I'm McDonald's Corp, I'd fight this tooth and nail!

Yup - and if they advertised their products as "peanut free" when, in fact, they contained peanuts or peanut residue, they'd be looking at a lawsuit as well.
False advertising is against the law - it's considered lying, making false promises, defrauding customers, etc.

They'd lose. You can't advertise your food as being halal when it isn't.
