Republican overlords are not happy:
"A group of Republican legislators is planning to file a lawsuit to stop the clerk in Dona Ana County, which is the second largest county in the state."

The clerk is fine with it, wanted to do it years ago, but the AG said it was illegal and she didn't want to issue invalid licenses.

But Santa Fe County Clerk Geraldine Salazar--who had said she believed the ban on same-sex marriage was unconstitutional--wasn't ready to act. That all changed at 1:30 p.m. Friday after her office received the judge's order and the county attorney reviewed it. "Now is the time to right the wrongs for years, hundreds of years, of oppression against the gay community," Salazar said. "And this is what's happening today."

As was stated, the Clerk has no issue with same-sex marriage and wants to sign licenses. It's merely a matter of her not thinking they are legally valid.

No, the judges (2 now) just doing their job and upholding Section 18 of the New Mexico constitution which says: "Equality of rights under law shall not be denied on account of the sex of any person." Court cases were brought before them and neither could find anything in the NM Constitution or legislation banning same-sex marriage.
