Republican overlords are not happy:

if its the law and that is the clerks job then I see no problem. he can find anther if it does not suit him/her.
The clerk is fine with it, wanted to do it years ago, but the AG said it was illegal and she didn't want to issue invalid licenses.

That all changed at 1:30 p.m. Friday after her office received the judge's order and the county attorney reviewed it. "Now is the time to right the wrongs for years, hundreds of years, of oppression against the gay community," Salazar said. "And this is what's happening today."
As was stated, the Clerk has no issue with same-sex marriage and wants to sign licenses. It's merely a matter of her not thinking they are legally valid.
No, the judges (2 now) just doing their job and upholding Section 18 of the New Mexico constitution which says: "Equality of rights under law shall not be denied on account of the sex of any person." Court cases were brought before them and neither could find anything in the NM Constitution or legislation banning same-sex marriage.
Dangit! I told my fiancé we'd move to NM of our marriage would be legal there. Ah well, at least they have clean air!
