Yes this is how it happens and most are to scared to do anything or cannot afford legal fees to fight!
At one point the IRS offered to settle the case with Dehko by giving back 20% of the funds that were taken. He, of course, rejected the offer, opting to sue the agency instead.
Well here is the reason!
There is a federal law that requires any bank deposit of $10,000 dollars or more to be reported. The IRS asserts that Dehko did an end run around the law by making many smaller deposits.
It is not illegal to make deposits of less than 10 grand, but it apparently sends up some red flags. Mr. Dehko’s attorney, Larry Salzman, said the deposits were frequently in the $9,000 range because his insurance policy will not cover him for loss or theft of more than $10,000 in cash.
Wow, that's crazy. I thought what was quite significant is that the IRS performed an audit and determined he did nothing wrong. At that point, they should have returned his money. I do hope he prevails in his case.
And when it comes to the IRS you are guilty until you prove your innocence.
I had dealings with them once and it took 6 months to straighten out.
You never get the same person twice and they threaten you with fines/jail time even while you are communicating with them.
And even after that they don't let go.
The money should be paid back with interest and a penalty for suffering and court cost
I think the obama administration should investigate this and see if it is racially motivated. Or if it is because he is a Christian from Baghdad, Iraq.
And Yes I agree he should be paid back with interest and an additional for pain and suffering because this money was taken from them causing hardship to the small business owner.
