Depends what the rules are when it's legalised. If you can only hold a certain amount etc. Then those under Yes, over No.

It's a difficult one. I wouldn't have arrested any of them to start with.

Yes, and many of them will be.

The ex post facto rule only operates in one direction, i.e. in the defendant's favor, whether anyone agrees with it or not (and I sure do agree with it.)

What a stupid country we are to make marijuana illegal. It was discovered in I think around 6000 BC and used for a variety of medicinal purposes among other things. Yes, let these people out of jail. I can't tell you how many I know that use it for a multiple of medical issues and it works for them. What exactly are we scared of when it's a life saver for some.

A neighbor had 100 acres stolen from him by the state because he was found growing some mj. That land has now been sold off to someone else. The drug war has always been about wealth confiscation and nothing more.

These stoners are unemployable because they won't be able to pass a drug test. You will be paying for their meals anyway through welfare.

I just checked the jail roster for one of the counties in Washington state where mj was legalized. There were three people in on old mj charges out of maybe 100. Three years ago there were as many as 25% in jail for marijuana charges. Now in Washington you can possess marijuana but its still illegal to grow marijuana. A side effect is that some of the cities and counties now find themselves with excess jail space and have had budget problems because cities that pay to used the jail arent bringing as many people in.
