It looks like that champions of equality and the Constitution will soon be able to add Virginia to the win column:
"The attorney general of Virginia has concluded that the state’s ban on same-sex marriage is unconstitutional and has joined the suit that challenged the law in federal court, a spokesman for the office said Thursday.
Michael Kelly, a spokesman for Attorney General Mark R. Herring, said that instead of defending the ban, 'the Commonwealth will side with the plaintiffs in seeking to have the ban declared unconstitutional.'"

This is what should be done. I listened to the legal arguments against gay marriage. And you know what I learned? There aren't any arguments based in American law to justify banning gay marriage.
Why waste tax payer money on a something that doesn't exist.

He isn't forced to use state funds to defend challenges to the law. Not to mention he made it quite clear before he was elected in November how he viewed the issue and he won.

I think the AG is wrong. He is not elected to enforce laws selectively. He is elected to enforce the law, period. He doesn't get to decide if it is Constitutional or not. That isn't his job. He is acting as a tyrant.

You're confusing enforce and defend. The State of Virginia is most certainly enforcing the law.
And the Attorney General most certainly does get to offer the legal opinions of Virginia's executive branch.
