I also noticed, albeit quickly, that Libby isn't contesting his indictment. I'll have to dig the article out.

Is something in the works?

Anyone see, read or otherwise anything new on the Libby case?

I haven't seen anything new on Libby. But I've always figured the only reason Bush commuted his sentence when he did was that the appellate court ruled he had to start serving his time, and Bush wanted to keep him out of jail.

I imagine Bush will hold off on Libby's pardon until the end of his presidency. I'll be very surprised if Bush doesn't give him one.

I'm sure bush will pardon him when he leaves office. I also heard that an appeal was too costly.

"We remain firmly convinced of Mr. Libby's innocence," his lawyer, Theodore Wells, said in a statement Monday. "However, the realities were that after five years of government service by Mr. Libby and several years of defending against this case, the burden on Mr. Libby and his young family of continuing to pursue his complete vindication are too great to ask them to bear."

Wells said the decision not to continue the appeal was tactical.

"The appeal would lead only to a retrial," he said, "a process that would last even beyond the two years of supervised release, cost millions of dollars more than the fine he has already paid and entail many more hundreds of hours preparing for an all-consuming appeal and retrial."

The decision also reflects the political reality that if the appellate court granted a new trial, it would probably occur during the administration of the next president, who might not share Bush's interest in helping Libby.

Libby wouldn't have any problem raising the amount required for a full appeal if he really thought he had a chance of winning it.

If I am not mistaken, if Libby appeals his case and wins, then he opens the chance for another trial. In which event would open him up to potential charges on other matters and a pardon or commuted sentence would then be unlikely. He knows where his bread is buttered and he isn't about to open his mouth.
