  1. He knew he was HIV positive
  2. He choose to have unprotected sex without giving the partner fair warning
  3. He intentionally infected others with the HIV virus
Remember Typhoid Mary? She was a carrier and worked as a cook. She infected people who ate the food she prepared. Once she was discovered to be the carrier, she was informed. She still went out and began working again. Again people she cooked for began getting sick. The last time the authorities found her, she was locked away for life time of quarantine.

I see your point. However, I wonder. If I have a cold, TB, syphillis, the flu, or any other infectious illness, and you catch it, did I commit a criminal act?
