This week, the Supreme Court will consider the reverse discrimination claim of Marcarelli and a group of white firefighters. They all passed a promotion exam, but the city threw out the test because no blacks would have been promoted, saying the exam had a "disparate impact" on minorities likely to violate the 1964 Civil Rights Act.
One hundred and eighteen people took the tests; 56 passed. Nineteen of the top scorers were eligible for promotion to 15 open lieutenant and captain positions. Based on the test results, the city said that no minorities would have been eligible for lieutenant, and two Hispanics would have been eligible for captain. (The lawsuit was filed by 20 white plaintiffs, including one man who is both white and Hispanic.)
The exams were designed by a professional testing firm that followed federal guidelines for mitigating disparate racial outcomes, the plaintiffs say.
But after the results came back, the city says it found evidence that the tests were potentially flawed. Sources of bias included that the written section measured memorization rather than actual skills needed for the jobs; giving too much weight to the written section; and lack of testing for leadership in emergency conditions, according to a brief filed by officers of the Society for Industrial and Organizational Psychology.
"All were afforded the same notice, the same study period, the same exam syllabi, etc.," said Torre, who would only answer questions by e-mail. "The rest was up to the individual."

Yet another moronic rule, the guys who are best for the job don't get it because they are white. I always hear we should be treated equally, well it seems to be something said and not meant by those who say it.

A test doesn't necessarily measure who is best for the job. There are other considerations.

The test is for leadership positions. Positions that requires working knowledge of the job as well as skills involving reading, writing, and speaking. To have reached the level of being able to take the test, they already know how to physically perform the job of a firefighter. To advance in rank, they must show a higher level of knowledge above physical skills. All were given the same preparation and the same test. Being a captain in the fire dept is more than knowing the firefighting equipment and how to use it properly. If that was all it was about then any firefighter veteran can be a captain.

White guys are evil. Everybody knows. Women could get in on the action because they didn't even get to take the test. The test should have been written in vietnamese to make sure nobody passed. They work for less I hear with the added bonus of not bothering the supreme court with complaints.

If they were truly for fairness they would represent "all" nationalities, races, genders in the fight against injustice in America.
But they would rather go to Jena LA and protest a criminal teenager's release and fair treatment for bail nobody paid to that point. Who BTW is back in trouble with the law!

Good. That just proves the wisdom of Jesse Jackson and Al Sharpton. Those firefighters deserve their miserable lives. Nobody should care what happens to them. Jackson's and Sharpton's energy should be used for more worthwhile problems.


Oh, and I bet that this reverse discrimination thingy gets ruled against or thrown out as the vast majority of them do. Why? Because the notion of reverse discrimination is garbage.
