Saw on the news last night that the drunk guy has a long rap sheet that includes horse abuse. If that means what I think it means, then maybe he shouldn't be concerned with what another guy does with his sexual organ.

Watching the video, one thing I noticed is that the cops don't show up until after the bystanders have tackled the drunk. But as soon as he is tackled to the ground, a cop magically appears to arrest him. Was the cop watching the altercation prior to this - or did he just happen to arrive at that time? Lucky for him the civilians did the heavy lifting I guess.
You are being irrational. In criminal law the mindset of the criminal is important in many types of crimes and the police investigate the mindset of criminals all the time. It's called motive. Literally a huge part to proving people comitted a crime comes down to establishing a motive for doing so, which is their mindset
Deciding if someone committed premeditated murder is about mindset, second degree murder, etc
So it is a fact that the mindset of the criminal is important in how we adjudicate Justice and the police investigate the mindset of criminals in some crimes.
So the question becomes for conservatives why isn't the mindset of the criminal important in hate crimes?
Why is that so upsetting and so wrong for the police to investigate the mindset of the criminal in those cases?
Motive is of course an important issue when investigating crimes. But it should have nothing to do with sentencing.
The man in this incident appears to have been motivated his drunken state and the sexual orientation of the man he kicked.
I see no difference though if the person he kicked was a fan of the wrong sports team, or voted for the wrong president, etc. Hate is hate.

Hate is a minimal reason for most crimes. Greed, jealousy, revenge, anger, stuff like that, create the bulk of assault and battery, not a specific characteristic of a victim.
There's a legit argument about enforcement of bias-motivated crime, like what type of proof is necessary, but the claim that all crime is motivated by hate is one of the bad arguments.

No, it's not. Each one is very different. Would you say that "homicide is homicide"? Do you not agree with the distinctions we make between 1st Degree Murder, 2nd Degree Murder, Voluntary Manslaughter, Involuntary Manslaughter, Felony Murder, Negligent Homicide, and Justifiable Homicide?

Because "hate crimes" victimize more people. They instill fear and angst in a community. Let's look at 2 cases of vandalism - 1) I graffiti your fence with the image of Kermit the Frog flipping of Ms. Piggy, and 2) I graffiti a Synagogue with a swastika and the words "Jews Deserve Death." Are you really going to claim that "vandalism is vandalism" and treat them exactly the same?
Also, people who victimize others because they are black or because they are Christian or because they are gay have been show much harder (if not impossible) to reform. These are just two of the reasons why bias motivated criminals are punished more harshly.
