No it doesn't. Any code of conduct at a public university that requires students to waive away their constitutional rights is unconstitutional and unenforceable.

They agreed to the code of conduct....they violated the code of conduct.

I think he jumped the gun but we don't really know what the university's investigation has yielded so far. Maybe the two he expelled have a history? We don't know. I do think the outrage over the chant has created a momentum that has swept up the university, but OU has lawyers who presumably reviewed the school's code of conduct regarding this expulsion.

So, when you waive your right to counsel or to remain quiet when questioned by police, that's unconstitutional? You can and do waive your rights all the time....
