I agree its over and that there is likely not going to be any bigger outcome here but its still good to dispel wrong ideas such as free speech only covers political speech.

The type of comment that was brought up definitely would be, and I bet the university's bylaws would say the same.

Why expelled Oklahoma frat boys would have an ‘excellent chance’ in court

Private institutions — like Sigma Alpha Epsilon — can freely punish speech that breaches their codes or standards. But a public institution such as the University of Oklahoma, which takes public money, operates as an arm of the government under the law. “So, in effect, it’s not a university punishing a student for a racist video or social media post, it is the state itself acting against an individual — a person, importantly, with all the rights guaranteed under the First Amendment,” wrote the University of West Alabama’s Will Nevin on AL.com.

“Yes, the students could bring a suit based on the First Amendment challenging their expulsion,” constitutional scholar Erwin Chemerinsky, dean of the law school at the University of California at Irvine, told The Washington Post late Tuesday evening. “Based on what we know from the media, I think they would have an excellent chance of succeeding.”

If that were actually true, every university in the U.S. would have to be shut down.

They weren't expelled. They voluntarily withdrew.

Many of those people you are slandering calling racists (yes, that is slander) have denounced the actions of those frat boys on the bus. Some involved are attempting to discuss the legality of expelling the students only to have their voices shut out by claims of RACIST!!! This board is turning into an online version of Jerry Springer.

Universities get to hold fraternities under their jurisdiction to specific codes of conduct. There really isn't any other argument beyond that.
