You still post in the present tense ("that is up to the prosecutor") but it has a already been pointed out that you "just passed along" a 2 year old case that was decided in the defendant's favor a year ago.

That's not correct. The guy was convicted, the conviction was overturned due to a judge's error, and now he is being retried. He alledgely hired a hit man to try to kill the witnesses before his retrial. He is not off the hook, he's actually looking at more charges than before.

Another person who does not pay attention to dates or bother the read stories. The Virginia state supreme court overturned the conviction and he is currently being retried. The allegations of hiring the hit man are from 2015, for his new trial.
