The surrogate mother can claim the deduction and pass it on to the gay couple.

I did not know that such things were eligible for any type of tax deduction or credit. Yet, if available for married straight couples, should be so for married gay couple.

Shouldn't be deductible for anyone of any persuasion. Having kids is a choice.

I did not bother to wade through the IRS regs, but this website seems to know what it is talking about:

Simply, IVF is not given any special treatment. It falls under the 'medical expense' deduction one may claim if said medical expenses are over a certain percentage of your gross income, and you are filling itemized deductions.

Hmmm. Learn something new everyday.

The IRS needs to change their laws to accommodate gays.
Once it's declared that they have all the same rights then they have to be give all the same rights as straight people.

If you choose to partner with someone of the same sex being the same gender is no free pass to deductions.
