The whole excuse just makes no sense. In another account it tells how the snipers caught the guy's kid also... who had gone looking for his father... then after they let him go the kid heard the order given to shoot his father. Some of the soldiers testify there were potential hostile men 100 yards away, other soldiers present said they did not see any such men.
In any case, you want to silence a non- combatant you have pinned down that is making noise and flopping around, you follow military regulations and you gag or at worst knock the guy out. You don't shoot multiple bullets into him. Which despite your "maybe it is a car backfiring a couple times" suggestion, would most likely attract said strange men, if in fact they existed at all.

It would appear that the soliders were suffering from some exhaustion. Still no excuse. The NCO was demoted, but the other guy pulled the trigger.

Obviously they understood they screwed up when they planted the weapon.

How much time passed between Al-Janabi stumbling upon the sniper team and his shooting?

The Staff Sargeant WAS charged,as was one other I believe-both were acquitted of murder.
Only Vela has been found guilty.

Time enough to search and determine that he was unarmed...
Vela was the one who pulled the trigger if I am not mistaken.
How long would it have taken to butt stroke the victim. A mean head ache and he would have been managable. I would have butt stroked him.
Yeah been there done that. I have also been in the postion of not having slept for several days and been surrounded by the bad guys. Lay low and pray. There are always options other than squeezing a trigger.

tinman, I don't mean to come off as a jerk, but I honestly can't understanding doing harm or worse to anyone, for any reason. None of it makes any sense to me in any way. It never will. I do break it down to minutia because none of it makes sense. Violence never benefits anyone.

You're fortunate. It's sure kept me from getting hurt worse than I did a time or two (or more). And I've never been an aggressor. Or a fast runner.

I doubt if a day goes by anywhere where a person successfully defends themselves against someone meaning to do them harm.

One of the reasons I don't live in the US.

I had a gun pointed to my head when I was 16. What could I do?
He was going to shoot me or not, for some reason, it was not.

I think that is rather simplistic. Violence is a terrible thing, but sometimes being violent stops greater violence from happening.
