You are conflating sex and robbery and physical assault. No one consents to being robbed or beaten up.
I don't care about this topic. All I know is if someone accuses me of a serious crime, I want the court to damn sure make the accuser prove it.
Ummm, nobody consents to being raped either. When used in proper context, the very word is self defining, to exclude consent. I haven't seen anyone advocating that right to a fair trial and proper presntation of evidence, be denied anyone. False accusations are actually not all that common a thing. Most rapes are not fabricated stories. Not so many as we are led to believe at all. Cases of false accusation have , certainly, happened, and they make the news, while real cases do not. Not unless the victim is a high profile individual.
Any idea how many women get raped, who don't even tell anyone? I don't know an exact figure, but I do know its a large number. Why don't they report it? They're scared to death, traumatized, and don't think anyone will listen. Whether the fleabag who raped her is an alley skulking bipred, or maybe even their boss, one might come back and kill her if she reports it, and one might cost her a job, and a bucket load of shame and recrimination.
As far as rape goes, my sympathies are with the victims. Yes, I would say that you are correct, as to where the burden of proof lays. The system, most certainly, agrees. Seeing what a rape victim is subjected to ,within that system, makes it even easier for me to empathize.
This is sounding dumber and dumber with every post. A pretext? Anyone with even half a brain knows the questions, as phrased, were inappropriate. Even his daughter said the questions were disgraceful.
The initial argument you people were making was that it's the judge's responsibility to ask questions to get to the truth.
My post simply pointed out there are better ways to phrase questions and now you're arguing there is some nefarious motivation.

Do you know how often false accusation happens? Not anything scientific, but a poll conducted in a police forum, 9 out of 10 rapes were false - some police officers went years without seeing one true rape.
I don't know what the true number of false accusation is but I think it's great enough to be a real concern.
In this particular case, I would not convict the suspect based on the information provided - it doesn't sound like rape to me.

And went on to say rape allegation is analogous to robbery or physical assault allegation. She is essentially arguing that merely an allegation of non-consensual sex means the rape in fact happened as long as it's established sex happened.

These types of threads always bring out the people who have repressed sexual memories, zero respect for women (because the average woman would want nothing to do with them) or have sexually taken advantage of someone who was too inebriated to consent.
