From what I've read it looks like the ony thing they are going to charge the officer with is that Garner's civil rights were violated? I could be interpreting what I've read wrong, but how do you even prove that?

Easy as pie. They are automatically guilty because they messed with a black persons.
D.C. replaced the lawyers and FBI agents investigating the case. I haven't seen any reports that New York team 'refused' to prosecute. Apparently, D.C. thought they were taking too long to do the politically correct thing and charge the police officer.
Any charges would still be brought in the state of New York in a federal court. Potato/Potato.
