She would probably use the "fighting words" defense.

Well...maybe not:

fighting words

n. words intentionally directed toward another person which are so nasty and full of malice as to cause the hearer to suffer emotional distress or incite him/her to immediately retaliate physically (hit, stab, shoot, etc.) While such words are not an excuse or defense for a retaliatory assault and battery, if they are threatening they can form the basis for a lawsuit for assault.

I wish i could hear what was being said. I mean, it would be totally weird for a guy just to go up to a random table and start mess. Was there a relationship? Was she cheating on him? At least that would put some clarity to things.

Interesting thing on the poll. Its a tie between all three choices!

I saw the video. The video is pretty violent. She hit him first so I am confused why she was not charged too. Women should not be putting their hands on anyone. I think she understands that now.

I don't know about that, if anything, she understands that she can start mess, get hit, be the aggressor but yet get the other person charged.

If she did learn anything, it was how to get away with it.

Anyone wrote this yet? They're entitled to equal rights. And lefts.

I've watched a number of videos like this on YouTube and one thing I've noticed is that men will take it for a short time but when they finally reach their limit and strike back, it's with full fury and all guns blazing. Women cannot withstand that kind of retaliation due to their physical inferiority.

He's lucky he didn't kill her when she hit her head on the table.

He should be in prison.

The same stupid school, is it not, who expelled kids for singing a song on a frat bus but let a violent woman abuser stay on the team. Isn't it?
Give me a break. This girl shoved him and then hit him on the face. Yes, he should know not to punch a woman back but a lot of that was instinctual and many people would probably shove or slap the person back if someone hit them on the face.

This is not one of those domestic abuse scenarios where he was dating her and lost his temper and just assaulted her. This girl antagonized him but didn't stop there. She took it one step further and shoved him and then that wasn't enough, she hit him in the face too. Let's just ignore all of that. It's entirely 100% his fault

Agreed but if you watch the tape, his reaction was so quick. It didn't look like he deliberately thought about punching her. With a lot of those athletes, they grew up fighting and defending themselves. It's a gut reaction. if someone hits you in the face, you react. I think he is a good guy. He was just out of high school and a lot of young people his age would probably react the same way if someone went after them and hit him in the face. She shoved him first and he did nothing. It wasn't just she went to the face that he reacted. I think he made the wrong decision, but I think he it was more out of immaturity. He just happens to be an a strong athlete.

His punch was reactionary to an attack on him; therefore, I don't think he should have been charged. If he had moved back, composed himself and then stepped up and punched her, that might have been different.

She should have been the only one charged going by the information presented.

I didn't read all the replies, but in my opinion, you should never hit a girl.

But he could have pressed charges on her if he wanted to, if he didn't hit her.

I know one thing though, I bet she'll never do that again.
