As clear as the law is, the actions of this Judge scream, "Domestic Enemy." Abetting the invasion of this nation, unlawfully and dangerously to our sovereignty.
The Founders gave the Supreme Court the ability to determine the Constitutionality. They would have made the Constitution less vague if they intended a strict interpretation. You have to understand that the Founders lived during the Enlightenment and saw great change in the their world and made a framework to deal with that change.
No they did not.
The Supreme Court gave themselves that power in "Marbury v. Madison". It is called "Judicial Review".
"To consider the judges as the ultimate arbiters of all constitutional questions [is] a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy. Our judges are as honest as other men and not more so. They have with others the same passions for party, for power, and the privilege of their corps. Their maxim is boni judicis est ampliare jurisdictionem [good justice is broad jurisdiction], and their power the more dangerous as they are in office for life and not responsible, as the other functionaries are, to the elective control. The Constitution has erected no such single tribunal, knowing that to whatever hands confided, with the corruptions of time and party, its members would become despots." - Thomas Jefferson
"This member of the Government was at first considered as the most harmless and helpless of all its organs. But it has proved that the power of declaring what the law is, ad libitum, by sapping and mining slyly and without alarm the foundations of the Constitution, can do what open force would not dare to attempt." - Thomas Jefferson
Don't believe what they teach you in school. It is mostly lies.
"John Marshall has made his decision; now let him enforce it!" - Andrew Jackson
Do you know what that means? How can the Supreme Court enforce any decision? Only the Executive has the power to enforce laws/orders/directives/etc.
The Supreme Court was supposed to settle disputes between the states, or foreign parties, or other "federal crimes". It was not supposed to interpret the Constitution.
Yeah, and what say Washington D.C. just ignores the courts order and reinstates their handgun ban? Or we could just ban all guns and ignore what the court said about the Second Amendment?
Even if Trump decided to ignore the courts, it would take a lot more people than just him to make it happen. Trump wouldn't be able to enforce a travel ban all on his own. You'd have to essentially have thousands of people within the government agree to essentially rip this country's system of checks and balances apart and usurp authority. You think that's gonna happen?
Our system of government only works because those within in operate on a good faith basis. As soon as people start going rogue, we no longer have a government, we have anarchy, and totalitarianism soon to follow.
I support Trump's travel ban, but I DON"T support the reckless and irresponsible idea's in your article, OP....
