People who want to have sex should go to the center where they have blood alcohol tests, sign consent contracts that get notarized and go through some basic training to ensure no boundaries are pushed.
Yah. It's kind of a Horseshoe Theory thought experiment. Far right Christian Conservatives want a signed consent form (i.e. a marriage contract) and far leftists are starting to come around to wanting a signed consent form too.
There's no black or white answer to this issue and each case has to be looked at individually. If she's stumbling drunk and takes a cab home and a sober taxi driver has sex with her, that might lean towards rape. If it's 2 drunk party-goers who have been making out all night and there's no signs of force/bruising/etc then that might just have to be chalked up to a drunken regret.
Sure there is. If the person is white, she or he is automatically guilty; if the person is black, she or he is always a victim of institutionalized racism.
If a woman can't consent, don't have sex with her. That is what Biden is saying. If she's drunk, incoherent, passed out... don't put your penis into her vagina... don't touch her in a sexual way at all, actually...because she's not able to say, "yes, that's what I want." Even if she had been making out with you earlier, it doesn't give a free pass to sex. Her being inebriated is neither here nor there. She still owns her body, regardless. The fact that she put alcohol into it doesn't make it public property. It's not a good idea to get black out drunk, of course, but it doesn't mean that it's a free-for-all. The old, "But she was drunk! She obviously wanted it!" shtick is past its prime.
Biden's words are meant to protect both the girls and the boys in this situation. Some college boys don't get that knowledge at home, so it's important that they hear it. No one wants a kid's life ruined because he was truly ignorant and believed that a drunk girl means free sex.

Do drunk girls have sex? YES, but we all know the difference between drunk and drunk.
As several posters have stated, an incapacitated or passed out person, man or woman, can't give consent. That is the current law.
According to Biden, a drunk woman is drunk and a college man is a rapist if they have sex and she is "drunk". That is not current law. Biden offered no qualifier for what "drunk" means in his statement. I assume Biden meant exactly what he said. Drunk means drunk, not passed out and incapacitated.

I agree. But I don't see that sort of distinction being made by people who write about things like this (Jezebel, Everyday Feminist, Slate, and others) as well as by some college campuses.
When people express outrage over things litme these, what they are really upset about is the fear of unfounded accusations of rape.
But anyone with any sense should know that if a girl is drunk to the point she is incapacitated or not fully alert, and someone has sex with her without her full or cognizant approval, then that is rape.
Rape IS a huge problem in our society, in colleges, in the military, and we are a society that continues to blame the woman for being raped ("she shouldn't have worn such a revealing outfit).

Considering how many people believe sex at ANY level of intoxication beyond mildly buzzed is rape (but only for the woman because they're more feeble-minded than men or something), including tons of university disciplinary committees, it's not at all clear that's what he means.
No, the logical solution (to this illogical argument) would be "never have sex when even mildly intoxicated or when your partner is even mildly intoxicated."
