If you can't see the problem of having a federal judge who is married to a WH lawyer, you're not very bright. It is a huge conflict of interest, since the judicial branch is supposed to keep the executive branch in check, to prevent a dictatorship. Its called balance of powers. Did you flunk out of Government 101?

A senior white house counsel might legally be considered NOT in government, they probably work for a law firm, who then does business with the government. Their employer would be the law firm.. not the taxpayer
