Amazing, 200+ years of close scrutiny of this document and it took her to find it. Why, she's like the Indiana Jones of the Constitution!

The judge opined:
“It ought not to be — and it has never before been — that those who have lived without incident in this country for years are subjected to treatment we associate with regimes we revile as unjust, regimes where those who have long lived in a country may be taken without notice from streets, home and work. And sent away," Judge Forrest said, reading from the written order she delivered soon after oral arguments.

However, this is false. There are nearly countless instances of people being yanked into custody years, and even decades after their offense....despite having lived without incident in the period between, after being uncovered as suspects, or apprehended as fugitives.

So the basic fundamental argument put forth by the Court is itself a lie and a fiction.

She compounds her judicial malfeasance by further declaring: “We are not that country; and woe be the day that we become that country under a fiction that laws allow it.”


This reminds me of Obama and how he would just make up lies about the history of America, then proceed to proclaim what kind of country "we" were not.

The real danger is that these judge interpret the issue how they feel it should be interpreted and then that becomes Case Law unless it's overturned by a higher court.

Yes anyone can see this is a horrible stinker of a decision. We are not that country? That is not for YOU to decide. Your job is to interpret the laws.. which are clear.

I can't find the ruling itself. If anyone does, please post so we can see what was the actual basis of the ruling. From the news reports, it appears that the individual in question still had a week to go before being deported, yet was arrested, handcuffed, etc., when he appeared for his usual check-in with ICE.

Travel documents had arrived from Trinidad. He was taken into custody to be deported.

It is hard to comment without knowing what her ruling was based upon.

Because it’s a trial court it has no binding effect.

Let's see how those facts square with the #metoo "movement".
