Hillary didn't know that a private server was wrong. She asked other Secretaries of State what they had done, and she made a choice that she thought was the best choice. It wasn't. But again, there is zero evidence that her bad choice had bad consequences. There is zero evidence national security was compromised. ZERO evidence.
Doesn't matter...

"Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—
Shall be fined under this title or imprisoned not more than ten years, or both."

Good luck with the lawsuit, is he paying out of pocket or is it some right wing group.
Hillary knew she knowingly transmitted classified email on an unsecure server...in fact she instructed huma to remove the classified marking to send something to her since it wasn't secure. Hillary is crooked...not stupid.

It should be interesting to see what answers or excuses are made to justify singling the sailor out while giving others a pass on the same and worse actions.

Why was a politically powerful person only extremely careless and another criminally responsible ?

How many of the classified emails put people in danger, I think you are exaggerating now. Maybe you have some other examples of gross negligence by cabinet members.

The IT tech was given immunity I assume to testify if he was directed to delete the emails by Clinton, I don't see that there was anything nefarious.

And to think that someone who can't handle gov't secrets with care thought she deserved to be president. Our youth is on the line and I wouldn't trust her safeguard secret information that could get them killed.
How much jail time does negligence get you. If the sailor wanted to claim a double standard a better example would be General Petraeus who knowingly gave out secret information. But then he couldn't bring Clinton into the conversation.

Only if you concentrate solely on sentencing. The Petraeus case actually adds weight to Saucier's suit:

Petraeus: convicted - no 'intent' established or needed
Saucier: convicted - no 'intent' established or needed
Clinton: absolved - 'Don't be silly, she didn't mean to!'

(For the sake of comparison, it should also be noted that the Petraeus and Saucier cases were handle by the FBI while Clinton's case was under the purview of the FBM.)

Pretty loose interpretation of the word intent.

"How many of the classified emails put people in danger,"

1st. It does NOT matter.

2nd. We KNOW she had SAP info on her private non-secure server, when KNOW she put those people in danger.

3. "Maybe you have some other examples of gross negligence by cabinet members."

When you INTENTIONALLY set up a NON GOVERNMENT owned sever OUTSIDE GOVERNMENT control on PURPOSE it has NOTING to do with what others may or may not have done. Beside NO OTHER cabinet member EVER set up a PRIVATE server, so your statement is useless.

"General Petraeus who knowingly gave out secret information." to a person who HAD a TS clearance.

The problem is she wa NOT "read in" on the info he gave her.

THAT s why the handling of classified material is so serious, unless you are a dem or a clinton.
