The nuances of sexual consent have been on the table recently thanks to the #MeToo movement, and one state in Australia is trying to clarify what consent should actually look like.
The new law states, in effect, that if you want to have sex you must ask for it clearly, and then hear a verbal “yes” back, under new reforms announced by the New South Wales (NSW) government in Australia, the New York Post reports.
So are we suppose to record each other saying yes, and record the whole thing with GoPros? LMAO! What if they're deaf, can't speak, etc? Would asking "Do you not want to have sex? count? That's a no? Kidding aside.
We all have to acknowledge that there's A LOT of grey area. Saying that woman are liars is just as bad as saying woman tell the truth. People are very deceitful, and will twist things around to align people to be on their side. It's either woman are protectless, and need protection, or woman have agency and personal responsibility. You can switch between the two when it's convenient for your case. Be consistent!
that law reminds of the movie cherry 2000 where before you could have sex with anyone, you need to have a contract dictating the terms of the relationship, including the length of the relationship, the terms of separation, etc.
Somehow that reminds of the deli scene in "When Harry Met Sally," with Meg Ryan shrieking, "Yes! Yes!"
Except this is no joke. It's a law designed to make it even easier than it currently is to prosecute men for rape when sex was actually consensual.
Quote:
Sex will be deemed rape unless a woman gives vocal consent, a minister in Australia’s most populous state has proposed.
Pru Goward, New South Wales minister for the prevention of domestic violence and sexual assault, said: “If you want sex you have to ask for it, and if you want that sex, you have to say yes.”
Ms Goward said the state was seeking to enshrine the requirement for a woman’s audible consent in law,
Except the article doesn't state that that ^^^^^ would have anything to do with it.
Is a married person in NSW entitled to have sex with his/her spouse anytime he/she want to (irrespective of what the spouse wants) ?
I doubt it.
