Actually, no.

Private business has the right to determine the type of clientele they wish to cater too.

As previously stated, numerous times, what these businesses are requesting is, don't ban smoking - but do require the smoking (or non smoking) policy of the business to be prominently displayed - that way EVERYONE can determine, on their own, if they wish to patronize that business.

I had no idea that allowing business owners to decide their own policy was special treatment.

I do think it is more special treatment to enact laws that intrude on someone else's property for your own comfort, should you decide to enter. But what do I know?

The law says, "smokers: step outside"

Even simpler.

No decisions, no signs, everyone understands everywhere, all the time. Even better, the smokers can't damage anyone else's health, just their own.

Smokers and businessmen do not have the "right" to endanger anyone else's health because of their harmful habit. Simple!

I had no idea that you had no idea that business owners are already regulated on a whole spectrum of issues affecting public health.

Even simpler: If an establishment (private business) determines that they WILL ALLOW smoking - the non smoker can determine it they will patronize that business - or not. If the business loses money because of that policy - the business goes out of business or, changes its policies.

That is called, freedom.

Business owners "suffering" under no smoking regulations can still elect to take money only from smokers, if they so desire.

They have that freedom.
