I did due diligence. There are no public use easements recorded on my privately owned property. Period.
But it sounds like it doesn't matter whether there are public use easements recorded or not, does it? So in the end, you have two choices. You either remain in your home knowing this is what you have to live with or you decide you cannot live with it and you move.

In other words, you were completely aware of what you were getting and is now POd that local authorities fail to agree with your interpretation of the law. Where did I put that tiny violin?
So you legislate for stupidity. I legislate for me not being responsible for your poor choices and/or stupidity.
All the deadbeats and those who made poor choices in life are not my problem morally or financially.

Deadbeats aren't my responsibility ether, but the difference between us, is that I don't wish to punish the responsible, and brand/treat them as criminals.
Some call it "research", some call it "due diligence". If the seller or his agent withheld material information, I'm sure you have a helluva lawsuit. If you just didn't care to check, that's on you. Reality is not obliged to conform to your interpretation of local law and statutes.
It doesn't need to. By statute and because of long-standing practice (which is cited in the statute), the public gets to use that sand. You can be stomp your foot & hold your breath all you want, but the statute exists.
