I don't understand how the government can charge an individual with theft if they find money on non-private (what most of you folks call public) land.

Is it theft if I'm walking down the street and find a penny on the sidewalk and pocket it?

Because when the money fell off the truck it appears as if these people saw that it did and the others likely heard it on the news immediately afterwards. If they knew where the money came from (as it really does not grow on trees on the side of the road as most folks know) they are responsible in making sure that it is returned or they are knowingly stealing what is not theirs. A no brainer.

How does the State know I saw it fall out of the truck? What about people who legitimately didn't see it fall out?

If your wallet falls out of your pocket and the guy behind you sees this happen, picks it up and pockets it - is that theft?

No, the State must prove that you knew the origin of the money. I don't know how that is possible.

The event was well publicized so people that found it were now well aware that it was not raining money.

Yes, because you saw the origin of the money and it wasn't purposely discarded.

The State has no way to prove that every individual that was picking up money knew where it came from.
