Likely that charge will get dropped, IMO, because of what you state. Also, the guy committed a different crime the same day.

In the linked article, it links to a CBS 13 Sacramento article from 2/15/2019 called "Man Facing Hate Crime Charge After Throwing Hot Coffee, Punching Sikh 7-Eleven Clerk". In the CBS 13 article, it said:

The man, John Crain, was arrested. Police say he admitted to assaulting the clerk the night before.

Officers say Crain stated he “hated Muslims” and attacked the clerk because he believed he’s Muslim. CBS13 has confirmed the clerk is Sikh.

OK, so this was a hate crime intended for a Muslim, not a Sikh.

Crap like this happens every day.

Internet/social media and 24/7 news cycles make us more aware of what probably would not be covered by a local paper, 20 years ago.
